TERMS OF PROVISION AND USE
OF MANAGED HOSTING AND EMAIL SERVICES

ARTICLE 1: DEFINITION OF THE POLICY AND SCOPE OF APPLICATION
This Policy governs the terms and conditions for the provision and use of managed hosting services, email services, domain name services, backup services, technical support, and related technical services provided by Mudeef Web Solutions.
This Policy applies to every individual, company, institution, or entity that requests, uses, or renews any service provided by Mudeef Web Solutions, hereinafter referred to as the “Client.”
This Policy shall constitute an integral and inseparable part of any of the following documents:
Quotation.
Service Request.
Invoice.
Purchase Order.
Contract or Commercial Agreement.
Technical or Financial Addendum.
Any written or electronic approval duly authorized between Mudeef Web Solutions and the Client.
The specifications of each service, including its duration, capacity, price, and any special terms applicable thereto, shall be set forth in the quotation, service request, or other approved commercial document.
ARTICLE 2: ACCEPTANCE OF THE POLICY
The Client shall be deemed to have accepted this Policy and to be bound by its provisions upon the occurrence of any of the following:
Signing the quotation or service request.
Approving the quotation by email or through an approved communication channel.
Paying the service fees in whole or in part.
Requesting activation of the service.
Commencing use of the service.
Requesting the transfer of data, a website, or email services.
Requesting renewal of the service.
Continuing to use the service after being notified of the version of this Policy then in effect.
The Client acknowledges that it has been given the opportunity to review this Policy and understand its provisions prior to approving the service.
ARTICLE 3: CONTRACTUAL DOCUMENTS
The contractual relationship relating to the service shall consist of the following documents:
The approved quotation or service request.
This Policy, in the version referenced in the quotation or service request.
Any approved technical or financial addendum.
Activation notices.
Written correspondence relating to the scope of the service.
In the event of any conflict between this Policy and a written and approved quotation, the expressly stated commercial and technical specifications set forth in the quotation shall prevail, while all remaining provisions of this Policy shall remain in full force and effect.
No oral promise or description shall be binding upon Mudeef Web Solutions unless recorded in writing in one of the approved documents.
ARTICLE 4: DESCRIPTION OF SERVICES
Depending on the approved quotation, the services provided by Mudeef Web Solutions may include one or more of the following:
Website hosting.
Database hosting.
Email hosting.
SMTP services.
Domain name and DNS record management.
Provision of SSL certificates.
Management of servers and hosted environments.
Backup and restoration services.
Monitoring of core services.
Technical support.
Transfer of websites, files, and databases.
Transfer of email accounts and messages.
Configuration of email security systems.
Management of security and operational updates.
Other technical services expressly specified in the quotation.
The actual specifications of the service, including storage capacity, number of accounts, allocated resources, backup retention period, and level of support, shall be determined by the approved quotation or service request.
ARTICLE 5: SERVICE TERM
The service term shall be specified in the quotation or service request and shall commence on the date on which the service is electronically activated.
The service commencement date may be evidenced by any of the following:
An activation notice.
Electronic generation of the service invoice.
An official email.
A notice issued by the service management system.
The first actual use of the service.
ARTICLE 6: PRICING AND PAYMENT
The service fees, payment method, payment due dates, and any applicable taxes or charges, if any, shall be specified in the quotation or invoice.
The Client shall pay all amounts due on the dates specified.
Mudeef Web Solutions may suspend the service, or any part thereof, in the event of non-payment of amounts due, following the issuance of appropriate notice whenever reasonably possible.
The prices do not include any resources, services, licenses, or additional work not expressly specified in the quotation, unless approved in writing or provided under a separate quotation.
ARTICLE 7: TRANSFER OF WEBSITES, DATA, AND EMAIL
Where transfer services are included in the quotation, Mudeef Web Solutions shall, within the technically available capabilities, perform one or more of the following:
Transfer website files.
Transfer databases.
Transfer technically available configurations.
Transfer email accounts.
Transfer existing messages where permitted by the applicable systems, protocols, and access permissions.
Transfer the domain name or assist in modifying its settings.
Modify DNS records.
Configure email security records.
Test the website, databases, and email services following the transfer.
Take reasonable measures to minimize the duration of any interruption.
The Client shall provide Mudeef Web Solutions with all login credentials, permissions, and information necessary to perform the transfer.
Mudeef Web Solutions shall not be liable for any delay, deficiency, or inability to complete the transfer resulting from any of the following:
Incorrect login credentials.
Unavailability of the required permissions.
Lack of cooperation by the previous hosting provider or service provider.
Restrictions imposed by the previous system.
Corruption or loss of data at the previous provider or service provider.
Failure to provide a complete copy of the data.
Use of systems or formats that cannot be directly transferred.
Expiry or suspension of the service provided by the previous provider.
Encryption or security measures preventing access to the data.
The Client’s delay in approving configurations or providing the necessary information.
Mudeef Web Solutions does not guarantee the ability to transfer all messages, folders, forwarding rules, contacts, or calendars unless the quotation expressly provides otherwise.
ARTICLE 8: OBLIGATIONS OF MUDEEF WEB SOLUTIONS
Mudeef Web Solutions shall:
Provide the service in accordance with the specifications set forth in the quotation.
Manage the core services falling within its scope of responsibility.
Apply reasonable operational and security configurations.
Monitor core services using the available tools.
Perform necessary maintenance and updates.
Provide technical support in accordance with the agreed service level.
Perform backups in accordance with the specified specifications.
Take reasonable technical measures to protect the service.
Address failures falling within its management scope.
Maintain the confidentiality of the Client’s data.
Notify the Client of material service outages or significant security incidents whenever reasonably possible and appropriate.
ARTICLE 9: OBLIGATIONS OF THE CLIENT
The Client shall:
Pay the service fees when due.
Use the service in accordance with applicable laws and regulations.
Not use the service for any unlawful, harmful, or fraudulent activity.
Protect login credentials and passwords.
Use strong and unique passwords.
Enable multi-factor authentication whenever available.
Keep user devices, operating systems, and security software updated.
Manage user permissions.
Disable accounts belonging to employees or users who no longer have authorization.
Ensure the legality of content, data, and messages.
Train users on information security, phishing, and social engineering.
Maintain independent copies of critically important data.
Notify Mudeef Web Solutions immediately upon suspicion of any security breach.
Not share accounts in an insecure manner.
Comply with the resource and usage limits specified in the quotation.
Cooperate with Mudeef Web Solutions in the handling of security incidents.
ARTICLE 10: SERVICE AVAILABILITY
Mudeef Web Solutions shall use reasonable technical and operational efforts to maintain a service availability level of 99.9%.
The following periods shall not be included in the calculation of service unavailability:
Scheduled maintenance, which shall be carried out at night according to GMT+3.
Emergency maintenance.
Force majeure events.
General failures affecting the Internet or telecommunications.
Failures of third-party service providers.
Distributed Denial-of-Service (DDoS) attacks.
Unknown vulnerabilities or Zero-Day attacks.
Failures caused by the Client’s applications or configurations.
Suspension resulting from a violation of this Policy.
Suspension resulting from non-payment.
DNS or domain-related errors outside the management of Mudeef Web Solutions.
Modifications made by the Client or any party authorized by the Client.
Exhaustion of the resources allocated to the Client.
Compromise of the Client’s accounts due to leaked login credentials.
The availability percentage represents a service-level target and shall not constitute an absolute guarantee that interruptions will not occur.
ARTICLE 11: TECHNICAL SUPPORT AND RESPONSE TIMES
Requests shall be classified into the following levels:
CRITICAL CASE
This includes complete service outage or general inability to access a core service.
Target initial response time: within two hours.
HIGH-PRIORITY CASE
This includes material degradation in performance or failure of a core feature while part of the service remains available.
Target initial response time: within four hours.
NORMAL-PRIORITY CASE
This includes configuration and modification requests, inquiries, and issues that do not materially affect business continuity.
Target initial response time: within one business day.
Initial response time means the commencement of reviewing the request or communicating with the Client and does not necessarily mean that the issue will be fully resolved within the same period.
The final processing period shall depend on:
The nature of the issue.
The complexity of the issue.
The availability of the required permissions and information.
The Client’s cooperation.
The cooperation of external parties.
The need for substantial updates or changes.
ARTICLE 12: SCOPE OF TECHNICAL MANAGEMENT
Depending on the quotation, technical management may include:
Management of core services.
Configuration of hosting settings.
Management of web, email, and DNS services.
Monitoring of resources and consumption.
Application of appropriate security updates.
Resolution of failures related to the infrastructure.
Creation and configuration of email accounts.
Management of SSL certificates.
Management of backups.
Execution of reasonable restoration requests.
Implementation of basic security configurations.
Configuration of anti-spam systems.
Unless separately agreed, technical management shall not include:
Website or application development.
Repair of programming or code errors.
Design modifications.
Programmatic database development.
Website content management.
Direct support for users’ devices.
Cleaning infected devices.
Management of external licenses not included in the service.
Advanced digital forensic investigations.
Extended security incident response.
Recovery of deleted data outside the available backups.
Training employees on the use of email software.
ARTICLE 13: BACKUP AND RESTORATION
Mudeef Web Solutions shall perform backups in accordance with the capacity, frequency, and retention period specified in the quotation.
Backups shall be subject to the following conditions:
Backups are an additional recovery measure and do not constitute an absolute guarantee against data loss.
Restoration shall be performed using the backups actually available.
Mudeef Web Solutions does not guarantee the restoration of an individual file, message, or item in all circumstances.
Restoration may require the restoration of an entire set of files, a database, or a mailbox.
Restoration may result in the replacement of current data with an older version.
The Client shall approve any restoration that may result in the replacement of current data.
Backups shall not include data deleted before a backup cycle or after the expiry of the retention period.
The Client shall maintain an independent copy of critically important data.
ARTICLE 14: EMAIL SECURITY
Mudeef Web Solutions shall apply the security measures available and appropriate to the email service, which may include:
SPF.
DKIM.
DMARC.
Anti-Spam Filtering.
Anti-Malware Filtering.
SMTP Authentication.
Rate Limiting.
TLS Encryption.
Limiting repeated login attempts.
Monitoring indicators of unusual activity.
Suspending accounts or messages exhibiting malicious activity.
Blocking suspicious sending sources.
Applying reputation and blacklist policies.
These measures are intended to reduce risks; however, they do not guarantee the prevention or detection of all malicious messages or threats.
ARTICLE 15: SHARED RESPONSIBILITY MODEL
The Client acknowledges that service security is based on the Shared Responsibility Model.
Mudeef Web Solutions shall be responsible for:
Managing and securing the core services under its management.
Applying basic security configurations.
Operating available anti-spam and anti-malware systems.
Securing available communication and encryption channels.
Applying updates relating to systems under its management.
Monitoring indicators of failures and security events within the available capabilities.
The Client shall be responsible for:
The conduct of its users.
Verifying the identity of senders of sensitive messages.
Refraining from opening suspicious links and attachments.
Protecting passwords.
Protecting end-user devices.
Training employees.
Independently verifying requests for financial transfers.
Managing permissions in accordance with the principle of least privilege.
Immediately reporting any suspicious activity.
Complying with security alerts and warnings.
ARTICLE 16: HANDLING MALICIOUS LINKS AND ATTACHMENTS
The Client acknowledges that email filtering systems rely on databases, signatures, behavioral analysis, domain and IP address reputation, and other security technologies. Accordingly, such systems cannot guarantee the detection of all current or future threats.
The Client and its users shall be responsible for exercising caution when:
Clicking links contained in messages.
Downloading or running attachments.
Entering passwords on pages accessed through email.
Responding to requests to change payment details.
Sharing confidential information.
Handling messages impersonating management or suppliers.
Bypassing security warnings.
Disabling security measures.
Installing software or extensions from untrusted sources.
Mudeef Web Solutions shall not be liable for damages resulting from:
Opening a malicious link.
Downloading an infected file.
Entering login credentials on a phishing page.
Sharing a password or verification code.
Responding to a fraudulent message.
Social engineering.
Identity impersonation.
Email fraud.
Business Email Compromise (BEC).
Infection of the user’s device.
Ignoring security warnings.
This shall not apply to damage directly and conclusively caused by gross negligence or intentional misconduct by Mudeef Web Solutions.
ARTICLE 17: NO GUARANTEE OF COMPLETE THREAT DETECTION
The Client acknowledges that email security, anti-spam, malware protection, and phishing protection services are provided in accordance with generally accepted industry best practices and reasonably available technologies.
Such services shall not constitute a guaranteed system for detecting or preventing all threats.
Mudeef Web Solutions makes no express or implied guarantee that its security systems will detect or block all of the following:
Phishing messages.
Malicious links.
Infected attachments.
New malware.
Zero-Day attacks.
Identity impersonation messages.
Fraud and social engineering.
Attacks specifically designed to bypass security tools.
Threats for which reliable detection indicators are unavailable.
Messages sent from legitimate accounts that have been compromised.
The Client acknowledges that security tools reduce risks but do not eliminate them, and that effective protection requires a combination of technical controls, security awareness, and user compliance.
ARTICLE 18: ANTI-SPAM POLICY
The use of Mudeef Web Solutions’ services for any of the following is prohibited:
Sending bulk messages without the recipients’ consent.
Using unauthorized mailing lists.
Sending spam.
Sending phishing or fraudulent messages.
Sending malware.
Spoofing email addresses.
Circumventing sending limits.
Negatively affecting the reputation of domains or IP addresses.
Conducting unauthorized scanning or testing.
Sending content that violates the law.
Sending messages containing misleading information or a false identity.
Using compromised accounts to continue sending messages.
Upon detecting malicious or unusual activity, Mudeef Web Solutions shall have the right to:
Restrict sending.
Change the account password.
Suspend the email account.
Suspend the SMTP service.
Block an IP address or device.
Require additional verification.
Suspend the service in whole.
Take measures to protect the reputation of the service.
Mudeef Web Solutions shall notify the Client of the action taken whenever reasonably possible, unless prior notification would increase the risks.
ARTICLE 19: EMAIL REPUTATION AND BLACKLISTS
Mudeef Web Solutions shall make reasonable efforts to maintain the reputation of the email services and IP addresses used.
Mudeef Web Solutions does not guarantee that all messages will reach the recipient’s inbox, as delivery depends on multiple factors, including:
The policies of the recipient’s email provider.
Domain reputation.
Message content.
Sending volume and frequency.
Recipient complaints.
SPF, DKIM, and DMARC configurations.
Blacklists.
Anti-spam algorithms.
The reputation of links and attachments.
Previous user activity.
If the Client’s activity causes a domain or IP address to be placed on a blacklist, Mudeef Web Solutions shall have the right to restrict or suspend sending until the cause is addressed.
The Client may be responsible for additional costs if removal from the blacklist or restoration of reputation requires extraordinary work outside the scope of ordinary management.
ARTICLE 20: SECURITY OF USER ACCOUNTS
The Client shall be responsible for protecting the accounts of all its users and shall implement the following practices:
Use strong and unique passwords.
Do not reuse passwords.
Enable multi-factor authentication whenever available.
Change passwords immediately upon suspicion of disclosure or compromise.
Do not transmit passwords through insecure means.
Update contact and recovery information.
Disable accounts belonging to former employees.
Review forwarding rules.
Review registered devices and sessions.
Verify that no unauthorized filters or rules have been created.
Do not share verification codes.
Protect user devices through appropriate software and updates.
Mudeef Web Solutions shall have the right to require a password reset or temporarily suspend an account upon suspicion that it has been compromised, in accordance with the applicable security algorithms.
ARTICLE 21: CONFIDENTIALITY OF INFORMATION AND EMAIL PRIVACY
Mudeef Web Solutions shall maintain the confidentiality of the Client’s data, information, files, and email content and shall not use or disclose such information to any third party except as provided for in this Policy or as required by law.
Mudeef Web Solutions acknowledges that email messages, attachments, and Client data constitute private and confidential information owned by the Client.
Mudeef Web Solutions and its employees shall not read or review the content of the Client’s messages as part of the ordinary administration or operation of the service.
The email service is primarily managed through technical systems and tools that process:
Service status.
Mailbox sizes.
Delivery logs.
Sending and receiving errors.
Sender and recipient addresses necessary for technical tracking.
Timestamps.
Error codes.
Spam indicators.
Malware indicators.
Login and security event logs.
Routing information and servers used for delivery.
Under ordinary operational circumstances, these processes do not require human reading of the textual content of messages or human access to attachments.
Mudeef Web Solutions shall not access the content of a message or mailbox except in the following circumstances:
Pursuant to a written request or clear authorization from the Client.
To address a specific technical issue requiring such access.
Where technically essential to address a security incident, provided that the Client is notified prior to taking such action whenever possible.
Where there is a credible suspicion that the service is being used for unlawful or harmful activity.
In response to a court order or legally binding request.
Through automated scanning performed by anti-spam and anti-malware systems.
Where human access to email content is necessary, Mudeef Web Solutions shall, whenever possible:
Obtain the Client’s prior consent.
Identify the account, message, or period subject to review.
Limit access to the authorized employee or technician.
Use the information solely for the required technical purpose.
Refrain from copying the content outside the systems except where technically necessary.
Terminate access once the purpose has been fulfilled.
Maintain the confidentiality of any information accessed.
Limit the scope of access to the minimum necessary.
Mudeef Web Solutions shall not sell email content or use it for advertising, marketing, or profiling the Client or its users.
The Client acknowledges that email systems may automatically process content or attachments for the purposes of:
Detecting spam.
Detecting malware.
Detecting malicious links.
Applying security policies.
Classifying messages.
Preventing harmful use.
Analyzing fraud indicators.
Automated processing shall not constitute human access to messages or a breach of the confidentiality of their content.
ARTICLE 22: PROTECTION OF LOGIN CREDENTIALS
Login credentials and permissions provided by the Client to Mudeef Web Solutions shall be considered confidential information.
Mudeef Web Solutions shall use such information solely for technical and operational purposes related to the provision of the service.
Mudeef Web Solutions shall take reasonable measures to protect login credentials against unauthorized access.
The Client shall change its login credentials after the completion of transfer or support work whenever there is no longer an operational need to retain such credentials.
ARTICLE 23: DATA PROTECTION AND SECURITY INCIDENTS
Mudeef Web Solutions shall make reasonable and considered efforts to protect the systems and data falling within its management scope.
Upon discovering a security incident affecting the Client’s services, Mudeef Web Solutions shall, subject to its technical capabilities and the nature of the incident:
Contain the incident.
Protect affected systems.
Suspend compromised accounts or services.
Collect the necessary technical information.
Notify the Client where appropriate.
Request password changes.
Restore services from available backups.
Take measures to prevent recurrence of the incident.
The scope of the service shall not include a digital forensic investigation or a detailed legal report unless separately agreed.
ARTICLE 24: LIMITATION OF LIABILITY
Mudeef Web Solutions shall use reasonable technical and operational efforts to provide the service in a secure and stable manner.
Mudeef Web Solutions shall not be liable for:
The content of data stored by the Client.
The content of messages sent or received.
The legality of the Client’s use of the service.
Data deleted by the Client or its users.
The use of weak or compromised passwords.
Compromise of the Client’s devices.
Opening malicious links or attachments.
Phishing and social engineering.
Financial fraud or identity impersonation.
Errors in the Client’s applications.
Service interruptions resulting from modifications made by the Client.
Interruptions of third-party services.
Loss of profits, revenues, or business opportunities.
Indirect or consequential damages.
Failure of messages to be delivered or their classification as spam.
Data loss exceeding the available backups.
Events outside reasonable operational control.
Unauthorized use resulting from the Client’s negligence.
Continued use of an account suspected of being compromised.
The Client’s failure to comply with security recommendations.
To the extent permitted by law, the total financial liability of Mudeef Web Solutions shall not exceed the amount paid for the period affected by the service that is the subject of the claim.
The limitation of liability shall not apply in cases of fraud, intentional misconduct, or proven gross negligence by Mudeef Web Solutions.
ARTICLE 25: SCHEDULED AND EMERGENCY MAINTENANCE
Mudeef Web Solutions may perform scheduled maintenance to improve performance, apply updates, or address risks.
Mudeef Web Solutions shall seek to:
Perform maintenance outside peak hours whenever possible.
Notify the Client in advance where a material impact is anticipated.
Minimize the duration of any interruption.
Restore the service as soon as reasonably possible.
Emergency maintenance may be performed without prior notice where delay could potentially result in:
Compromise of the service.
Data loss.
The spread of malware.
Damage to email reputation.
Disruption of other services.
A serious legal or security violation.
ARTICLE 26: ACCEPTABLE USE
The Client shall use the services lawfully and professionally.
The following uses are prohibited:
Unlawful activities.
Fraud or deception.
Distribution of malware.
Unauthorized access to systems.
Launching Denial-of-Service attacks.
Sending spam.
Identity impersonation.
Infringement of intellectual property rights.
Hosting content that violates the law.
Misuse of resources.
Conducting security scans without authorization.
Attempting to circumvent security systems.
Using accounts to send harmful content.
Hosting phishing pages.
Using the service in a manner that threatens its stability or reputation.
ARTICLE 27: TEMPORARY SUSPENSION OF THE SERVICE
Mudeef Web Solutions shall have the right to suspend the service, or any part thereof, in the following circumstances:
Failure to pay amounts due.
Unlawful use.
Sending spam.
Compromise of an account or strong suspicion of compromise.
Activity threatening service security.
Excessive use of resources affecting stability.
Failure by the Client to respond to an urgent security request.
Existence of a legally binding order.
Material breach of this Policy.
Damage to the reputation of a domain or IP address.
Exposure of other data or services to risk.
Mudeef Web Solutions shall take the least disruptive action whenever appropriate and reasonably possible.
Suspension may occur without prior notice where delay would increase security or legal risks.
ARTICLE 28: TERMINATION OF THE SERVICE
The service may be terminated upon:
Expiry of the subscription term without renewal.
The Client’s request for cancellation.
The Client’s material breach of its obligations.
Failure to pay amounts due.
Unlawful or fraudulent use.
Threats to the security of systems or data.
Continued sending of spam.
Use of the service for phishing or distribution of malware.
Continuation of a violation after notice has been issued.
Upon termination or expiry of the service, the Client shall be responsible for transferring its data to another service provider within a maximum period of five (5) days from the date on which the service expires or is terminated.
Data may be deleted after the expiry of the aforementioned grace period. Mudeef Web Solutions shall not be obligated to retain data after the expiry of the service term unless the quotation or a separate agreement expressly provides otherwise.
ARTICLE 29: RENEWAL AND PRICE ADJUSTMENTS
The service shall be renewed upon the agreement of both parties and in accordance with the prices and terms applicable on the renewal date.
Mudeef Web Solutions may adjust renewal prices in the event of changes in:
Infrastructure costs.
Licensing costs.
Storage costs.
Prices of external services.
Exchange rates.
Taxes and fees.
The scope of the service or required resources.
The Client shall be notified of the renewal price before the due date within a reasonable period whenever possible, allowing the Client to choose either to accept the increase or to transfer to another provider upon expiry of the current contractual period.
ARTICLE 30: FORCE MAJEURE
Mudeef Web Solutions shall not be liable for delay or non-performance resulting from circumstances beyond its reasonable control, including:
Natural disasters.
Wars and civil disturbances.
Internet or telecommunications outages.
General failures affecting service providers.
Government decisions or regulatory restrictions.
Large-scale cyberattacks.
Power outages.
Fire, flooding, or earthquakes.
Sanctions or international restrictions.
Any circumstance that cannot reasonably be foreseen or prevented.
Mudeef Web Solutions shall make reasonable efforts to restore the service and minimize the impact of the event.
ARTICLE 31: OPERATIONAL DETAILS AND INFRASTRUCTURE
Mudeef Web Solutions shall have the right to design, operate, and update the infrastructure used to provide the service as it deems appropriate from a technical, security, and operational perspective, provided that it does not diminish the material specifications expressly set forth in the quotation.
Mudeef Web Solutions shall not be required to disclose:
The internal design of the infrastructure.
The names of all suppliers or subcontracting entities.
Internal addresses and detailed network information.
Detailed security configurations.
Monitoring and management tools.
Information whose disclosure may weaken service security.
Detailed physical locations of systems, except where required by law or under a specific agreement.
Mudeef Web Solutions may use third-party infrastructure, storage, connectivity, security, or cloud service providers to deliver the service.
ARTICLE 32: THIRD-PARTY SERVICES AND PROVIDERS
Certain services may depend on third parties, including:
Domain name registrars.
Data center providers.
Cloud storage providers.
SSL certificate providers.
Anti-spam service providers.
Telecommunications and Internet networks.
Licensing and software providers.
Such services shall also be subject to the limitations and terms imposed by the relevant third parties.
ARTICLE 33: COMMUNICATIONS AND NOTICES
Communications sent through the official email address or approved support system shall constitute valid notices for operational and technical purposes.
Notices relating to termination of service, financial claims, or material amendments should preferably be provided in clear written form.
The Client shall be responsible for keeping its contact information up to date.
Mudeef Web Solutions shall not be liable for failure to receive notices resulting from incorrect or outdated contact information.
ARTICLE 34: AMENDMENTS TO THE POLICY
Mudeef Web Solutions may update this Policy where required for operational, security, or legal reasons.
Material amendments shall not affect a prepaid service term unless the Client is notified or the amendment takes effect upon renewal, except where the amendment is:
Required by law.
Necessary to address an urgent security risk.
Related to preventing misuse.
Related to protecting systems and data.
Not detrimental to the material commercial specifications.
ARTICLE 35: SEVERABILITY
If any provision of this Policy is determined to be invalid, unenforceable, or inapplicable, such determination shall not affect the validity and enforceability of the remaining provisions.
The invalid or unenforceable provision shall be replaced with a valid provision that achieves, to the greatest extent legally and commercially possible, the closest intended purpose.
ARTICLE 36: FINAL ACKNOWLEDGMENT
By approving the quotation or service request, paying the service fees, or commencing use of the service, the Client acknowledges that:
It has reviewed this Policy.
It has understood its provisions.
It has accepted this Policy.
It has the legal authority to approve the service.
The information it has provided is accurate.
Its use of the service shall comply with this Policy.
